We have provided services to just about 70% of the large oil exploration companies currently operating within the East Africa region. Our work for them has been around: reviewing and advising on the legal issues around Production Sharing Contracts; advising on the taxation regime of petroleum companies and their sub-contractors in Kenya; advising on the taxation of the rotators/drill rig operators in Kenya, both resident and non-residents; advising on the tax implications of farm down transactions (assignment of rights granted under Production Sharing Contracts); reviewing Farm Out Agreements (FOAs’) and advising on the legal and tax implications of the same, as well as amending such agreements to ensure the most minimal tax impact while observing compliance with the law; facilitating meetings between clients and the KRA to obtain clarity on grey areas, or discuss areas that portend adverse tax implications for our clients; and conducting presentations to clients on the various tax issues facing their exploratory activities, among others.
